President does not qualify?

Let me start this by sayin, I believe Barak Obama is a Natural Born US citizen and qualified to be President.

Now then, put on your make believe bonnets and say that President Obama turns out to have a fake Birth Certificate, tomarrow, what will happen?

For that we need look to the 20th amendment: "if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President elect shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified."

So then Biden would be sworn in as President. But wait! The amendment says he will act as President until a President shall have qualified.

So Peolsi and Dean could decide who should be president? **shudder** What a vague bunch of words that some court will have to figure out.

Until a President shall have qualified... Thank you 1933...

What? Obama was born in Hawaii. The last time I checked, Hawaii is part of the U.S. If he were born in a foreign country to an American parent, he would still be eligible for president because he'd be an American citizen at birth, as was John McCain.

This is a nonsensical conspiracy theory. Here's Obama's birth certificate. The same rumors were connected to McCain, who was born in the Panama Canal Zone to American parents.

Is the certificate a forgery? No. Is Obama a natural-born citizen? Yes.

Stella, the first line of this post was a disclaimer and link to the FactCheck.org site.

My posting was about curiosity around the vague wording of the 20th amendment.

That does not change the fact that certain people cannot accept election results and move forward.

What gave this conspiracy legs was that after 2004, it was widely thought that Obama was foreign born. There was talk (albiet, stupid talk, imho) of a new constitutional amendment to allow naturalized citizens to become President, with The Governator and Obama as poster boys for the movement.

Since that time, Obama has been shown to be born in the US by a birth certificate. Democrats control all aspects of the Hawaii government: they would never stoop so low as to forge a birth certificate. After all, it's only the Presidency at stake, not something important like Olympic Medals.

Lee, it might have gotten lost: Blogger gets iffy and loses content. No problem and no apology necessary. I came close to using moderation myself because of an annoying visitor. Now, I just delete the comments.

Shoo, thanks for the background on this urban legend. I hope you enjoy the Gubenator article from Esquire, which points out he doesn't need to run for president: he's already governing 12% of the U.S. population.

Don't know your opinion. Although he wasn't my first choice for governor, he's done a decent job balancing policies and conflicting interests.

I may not agree with both of you all the time, but I always admire your rationality and thoughtful comments.

The issue is, Hawaii will issue a 'natural born citizen' certificate with no designation of place of birth. Obama can put this all to rest by producing the document for scrutiny by an independent document forensic specialist. No one mentioned whst started all this----a recording of his Grandma claiming to be present at his birth. In Kenya.

He has a valid birth cert, there is zero evidence Ann Dunham expatriated. Period, done, end of story, the Man was elected President.... Deal with it.

In any case, Obama's mother was a U.S. Citizen, so it doesn't matter where he was born. Federal law cites that a child born to an American citizen—anywhere in the world—is an American citizen. There are Republicans whose citizenship and office were questioned for the same reason.

I know this first-hand: I was born overseas to an American father and was a citizen at birth. Despite being born overseas, I am eligible to run for president under the 20th Amendment.

As Lee says, "Deal with it."

I'm just asking questions. Didn't his mom relinquish citizenship? Wasn't his father Kenyan? It IS true that Hawaii will issue 'Certificates of live birth' for people born outside the U.S.... Why is the certificate held under lock and key? Wouldn't producing it end the whole thing? Why did his grandmother claim to attend his birth in Kenya?
Here's why it matters. If you're going to accuse Bush of thrashing the constitution for authorizing wiretaps for foreign nationals calling the middle east, it's important to adhere to the constitution elsewhere---not just where it's convenient. Same with Hillary getting a cabinet position, forbidden by article 1.

I'm sorry, flying van. Yes, Obama's father was from Kenya. Amendment II states No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President... I haven't found any source that states Obama's mother relinquished her citizenship. I'd appreciate any info you can find. I have posted a link to the birth certificate: it is available for public view.

Even if Obama was born in Kenya, although I don't have any data to prove this, his mother was an American citizen, so he became a citizen at birth.

Chicago Tribune has an enjoyably satiric article on the subject. This Salon article covers the birth question in great depth.

Other politicians encountered the same problem. John McCain wasn't (technically) born in the U.S., but in the Panama Canal Zone. (OK, I know, it was a U.S. possession.) Barry Goldwater almost couldn't run for president because he was born in Arizona before it was a state.

I absolutely agree with you: all citizens must adhere to the constitution whether or not it's convenient. About Clinton, you are absolutely right. The constitutional quandary arises from a clause that forbids members of the Senate from being appointed to civil office, such as the secretary of state, if the "emoluments," or salary and benefits, of the office were increased during the senator's term according to Article 1, Section 6.

My understanding is that the problem can be mitigated if she turns down the annual $10,000 annual raise. President Nixon ran into the same problem when he wanted to appoint Ohio's Republican Sen. William Saxbe as attorney general.

The solution back then, since dubbed the "Saxbe fix," was for Congress to pass another law (not without some outspoken dissent from Democratic senators, by the way) reducing the AG's pay so Saxbe wouldn't benefit financially from the higher salary he'd previously voted on. [Source]

Whether that's doing an end run around the constitution, I find the Clinton issue far more troubling than Obama's birth certificate.
